Article 1. General Terms
These Terms of Service constitute your agreement with MY-KEYS-TO-PARIS with respect to your use of the MY-KEYS-TO-PARIS Internet-based information service ("myKeystoPARIS "). " myKeystoPARIS " is a registered trademark. Each person or entity who or which accesses myKeystoPARIS must abide by all of the terms and conditions contained in these Terms of Service in order to become or remain an authorized User of myKeystoPARIS (a "User"). Both property renters and apartments owners are User. myKeystoPARIS may modify these Terms of Service at any time upon posting notice in myKeystoPARIS. If these Terms of Service or any future changes are unacceptable to you, you immediately terminate your use.
It is important that you read and understand these terms before using our services. By accessing or using Our Services, you agree to be bound by these terms, which may be modified from time to time.
Article 2. Our Policy & Service
myKeystoPARIS is a company based in Paris.
The company provides useful and readily accessible information on a selection of apartments based in Paris.
Our service is to give you a convenient way to make your on-line reservation for one of the apartments listed. We act as the intermediary between our website users and the participating apartments' owners. In some case myKeystoPARIS may represent the owner's apartment on his or her express demand.
Article 3. Disclaimer of Liability for Content
Changes are periodically added to the information in myKeystoPARIS. myKeystoPARIS and/or its respective suppliers may make improvements and/or changes in myKeystoPARIS at any time. myKeystoPARIS tries to ensure that all descriptions and photographs are as representative as possible, but these are not legally binding. myKeystoPARIS cannot be held responsible for any subsequent changes made in the apartments.
Article 4. Access to service
We cannot warrant that access to our website will be uninterrupted or fault free.
Article 5. Service Content and Use
User shall not upload to, or distribute or otherwise publish through
myKeystoPARIS any individual items of information and other material
("Content") which violates or infringes the rights of any persons,
including but not limited to, rights in copyrights, patents, trademarks,
trade secrets and other proprietary rights.
User shall not upload to, or distribute or otherwise publish through myKeystoPARIS
any content which is libellous, defamatory, obscene, pornographic, abusive
or violates any law, or which contains viruses, "worms", "Trojan
horses" or any other harmful properties, or use myKeystoPARIS
for, or to further, any illegal purposes.
User shall not, without the express written approval of myKeystoPARIS,
upload to, or distribute, broadcast (by e-mail or otherwise) or otherwise
publish through myKeystoPARIS any content containing any solicitation
of funds, advertising or solicitations for goods or services, except that
such restriction shall not prevent User from sending private e-mail in
the ordinary course of business.
Article 6. Copyrighted Material
"Content" accessible through the Service may be protected by copyright.
User may not copy, upload, distribute or otherwise publish any content
protected by copyright, without obtaining permission of the copyright
owner. User agrees to abide by any copyright notice or other restriction
contained in any individual content accessed through myKeystoPARIS.
myKeystoPARIS is copyrighted as a collective work under France
copyright laws. Except as expressly provided in these Terms of Use or
in the Service Agreement, User shall not copy, distribute, publish, or
create a derivative work from myKeystoPARIS or any part thereof.
By uploading to, or distributing or otherwise publishing through myKeystoPARIS
(except by use of private e-mail) any content, User grants myKeystoPARIS
the right to edit, copy, remove, distribute, create derivative works from
and publish such content in any form and medium, whether electronically
or in hard copy and whether alone or as part of a collective work, except
as may be otherwise expressly provided in a written agreement between
the User and myKeystoPARIS. Notwithstanding the foregoing, User
shall retain whatever rights he/she/it has in pre-owned elements of such
content.
User may download or copy content accessed through myKeystoPARIS
for personal use, including internal business use in the ordinary course
of User's business or profession, provided that User maintains all copyright
and other notices contained in such content. In no event may User, directly
or indirectly, sell or offer for sale any content accessed through myKeystoPARIS
or upload, distribute, or otherwise publish such content in any form or
medium except for occasional communications. User shall not store any
significant portion of any content owned by, or licensed to, myKeystoPARIS,
in any form, whether archival files, computer-readable files or any other
medium.
No User or such User's agents shall use myKeystoPARIS or any information
obtained from or through myKeystoPARIS to (i) solicit or participate
in the solicitation of myKeystoPARIS Users when that solicitation
is for the benefit of any entity which could reasonably be construed to
be or to become competitive with myKeystoPARIS or (ii) for a commercial
purpose not expressly sanctioned by a written agreement between User and
myKeystoPARIS. Further, the User agrees not to solicit any employee
or consultant to myKeystoPARIS to leave or not to renew such employee's
or consultant's relationship with myKeystoPARIS, and shall not
hire or engage any such employee or consultant while such employee or
consultant is employed or engaged by myKeystoPARIS.
myKeystoPARISdoes not necessarily endorse chats, postings, conferences,
and other communications by other Users, and such communications shall
not be considered reviewed, screened or approved by myKeystoPARIS.
myKeystoPARIS reserves the right for any reason to remove without
notice any contents of the forums in myKeystoPARIS received from
Users, including without limitation bulletin board postings.
Article 7. Indemnification
Each User agrees to indemnify and hold myKeystoPARIS harmless from
any dispute, which may arise from a breach by such User of these Terms
of Service. User agrees to hold myKeystoPARIS harmless from any
claims and expenses, including reasonable attorney's fees and court costs,
related to User's violation of these Terms of use.
Article 8. Contents - Edits and Deletions
myKeystoPARIS reserves the right in its sole discretion to edit
or to delete any content displayed, uploaded to, or distributed, or otherwise
published through myKeystoPARIS (other than content in private
e-mail communications).
myKeystoPARIS will maintain records of reservations and invoices in a reliable and professional manner in accordance with the provisions of Article 1348 of the Civil Code. (The computerized records of myKeystoPARIS will be considered by the parties proof of the communications, orders, payments and transactions occurred between the parties.)
